LOUISBURG, N.C. -

A second suspect in a double homicide in Franklinton Tuesday morning has been charged with two counts of murder.

Joey Kearney, 16, was charged with two counts of first-degree murder after being released from Wake Trauma Center where he was being treated for a gunshot wound to the arm. He was also charged with burglary and kidnapping, according to an arrest report.

Kearney's brother, 34-year-old Ricky Junior Toney, was shot and killed by a Vance County deputy.

Franklin County Sheriff Jerry Jones said Kearney was shot as Deputy Kenneth R. Wood struggled to arrest Toney on Smith Road on the edge of Vance, Warren and Franklin Counties.

Kearney was inside a stolen vehicle belonging to one of the homicide victims while Toney resisted arrest.

Toney and Kearney were wanted in connection to a home invasion and murder of 37-year-old Akesia Michelle Toney and her 16-year-old daughter, Brianna Nicole Jones, at 1755 West River Road early Tuesday morning.

A 911 call was made by one of the victims as the suspect came through the door, authorities said.

"During the initial call there was some talking heard and someone said, 'Don't hurt me don't hurt me,' then the phone line went dead," Jones said.

Jones said Akesia Toney was Ricky Toney's estranged lover and that she had received threatening text messages from Toney regarding a car that they owned together.

"They knew each other and there were some threats made by the suspect that we've found out this morning that a co-worker of one of the victims heard," Jones said. "There were some on-going situations."

Jones said there had been prior problems at the home where Akesia Toney and Brianna were murdered, including an allegation that Toney was sexually assaulting the 16-year-old.

Toney and Kearney were also wanted for questioning in the murder of a man in Vance County on Dec 2.

Wood was placed on administrative leave pending internal and SBI investigations.
