Wake schools seeks to recover $1M lost in alleged bond scheme

RALEIGH, N.C. -

The Wake County Public School System filed more than 300 motions Tuesday to recover money it lost through an alleged scheme involving two former Wake County court clerks and two bail bondsmen.

Attorneys representing the Wake County Board of Education filed 316 motions in Wake County Superior and District Court Tuesday to recover more than $1 million in bond forfeitures that are owed to the school system.

The motions came after investigation revealed that two former clerks and two bondsmen allegedly engaged in a scheme that resulted in bondsmen avoiding their obligation to pay bond forfeitures when criminal defendants failed to appear in court.

Under North Carolina law, the proceeds from criminal bond forfeitures are to be used to maintain the county's public schools.

Former assistant clerk Kelvin Lawrence Ballentine and deputy clerk Latoya Tanisha Barnes were indicted in February on charges of obtaining property by false pretenses, accessing a government computer and altering court records.

Bondsmen James L. Perkins and Kenneth Vernon Golder II were indicted on the same charges, in addition to misdemeanor bail bond violation.

If the school board's motions are granted, the school system stands to recover $1,012,600. In addition, the motions seek payment of 8 percent interest from the dates the bonds should have been paid.
