Laurence Lovette's life sentence upheld in Eve Carson murder

RALEIGH, N.C. -

Laurence Lovette, convicted in the 2008 shooting death of UNC student body president Eve Carson, had his second appeal to the state denied on Tuesday.

Lovette's latest appeal sought to challenge the constitutionality of his sentence.

The United States Supreme Court ruled it is unconstitutional to give an automatic life sentence to someone who was under the age of 18 at the time of a crime unless mitigating factors are considered. Lovette was 17 when the murder occurred.

Lovettte, 23, was automatically sentenced to life in prison without parole on Dec. 11, 2011.

The North Carolina Court of Appeals upheld the original sentence.

The court ruling read in part that the court has "...resentenced defendant under the new sentencing statute to life imprisonment without parole after making extensive findings of fact as to any potential mitigating factors revealed by the evidence."

Lovette is currently awaiting trial for his involvement in the murder of Duke graduate student Abhijit Mahato in January 2008.
