CHAPEL HILL, N.C. -

Just weeks after charges were dropped for one murder, a Durham man is back in jail and charged with another.

Brandon Shamar Townsend, 21, of Durham, is charged with first-degree murder and attempted first-degree murder in connection with the death of 33-year-old Lewhahn Hood on May 30.

Townsend had been released in April after 682 days in jail for the murder of 13-year-old Durham girl Shakanah China. Durham District Attorney Leon Stanback said just before Townsend was to stand trial that the charges were dropped for a number of reasons, including DNA evidence arriving late from the SBI.

Demetriss China, the mother of Shakanah, told WNCN Thursday, "I hope that justice will be served. Even though it's not going to bring my daughter back and it's not going to bring that person back or nothing like that right there, but justice should be served."

At the time Townsend was released, Townsend's attorney, Scott Holmes, said, "It says to me that they had to admit at that point that they had no case. That they lacked evidence against my client and they didn't even have enough evidence to try to explain to a judge why this case should continue."

Holmes said Thursday he no longer represents Holmes.

Shakanah's mother, Demetriss, said Townsend "shouldn't have gotten out from the first get-go ... If they would have kept him in there, I think that person would still be living."

Stanback said after reviewing the DNA evidence, he does not plan to charge Townsend in Shakanah China's death.

Police said Hood was found shot to death at the scene of a breaking and entering at 102 S. Christopher Road.

Bartholomew Romidas Scott was previously charged with first-degree murder in Hood's death.
